These are Funky Bunch’s standard terms and apply to all events conducted by Funky Bunch even if the Venue has not signed and returned them. 

Term of agreement: If there is no fixed term trial period specified above, or if it has expired, either party may terminate this agreement without any reason on one week’s notice. Regardless of any fixed term, either party may terminate this agreement if the other party has breached it in a material way or is late in paying money due under it.  If after the agreement is terminated or expired Funky Bunch conducts any other events at that Venue without a new agreement being made, these terms shall continue to apply to those events.   

Funky Bunch will:  supply questions, host, laptop (if required), wireless microphone (if required) and answer sheets for trivia/bingo nights of approximately 2 to 2.5 hours duration each week at the day and time noted above (or any other date and time the Venue and Funky Bunch agree). The questions will be Funky Bunch’s standard questions for that week and won’t be unique to the Venue. Funky Bunch will not charge any entry fee.  

The Venue will:  supply an appropriate space for the eventsupply the audio-visual gear noted above and make sure it is functioning and installed in positions appropriate to the event, promote the event (see below) and do everything possible to ensure that the Venue is a safe workplace for the host and any other Funky Bunch staff. The Venue will be responsible for posters, answer sheets and any other equipment supplied by Funky Bunch and will be liable to replace them if they are damaged or lost. The Venue will not charge any entry fee unless otherwise agreed with Funky Bunch.  The Venue will supply all prizes, and props (including drinks) for all activities. The venue will fill out the online Managers Report each week within 1 day of the show being run. 

Promotion:  Funky Bunch will include the Venue on the ‘gig guide’ page of its website during the week preceding each event and will supply Funky Bunch posters for advertising in the venue and will also occasionally mention the Venue on its social media.  The Venue must put up the Funky Bunch posters (and inform Funky Bunch when replacements are required) and must ensure front-of-house staff are aware of the event and mention it to patrons whenever appropriate. 

Payment:   The preferred method of payment is Direct Debit: Funky Bunch Entertainment Pty Ltd, will direct debit the day following the Trivia/Bingo event, where the venue has contracted Funky Bunch Entertainment Pty Ltd as their Trivia Provider (and any cancellations – see below). FBE will provide an invoice for the Trivia/Bingo event direct debit for reference purposes to the venue. FBE will terminate the direct debit fee if the venue discontinues with the Trivia/Bingo. 

If paying on terms, Funky Bunch will invoice the Venue for each event weekly.  The Venue must pay each invoice within 7 days of the scheduled event.  Funky Bunch may suspend its services during any time when an invoice is overdue.  If the Venue is late in paying an invoice, then Funky Bunch may require that all future events are paid in advance (and not provide the services if they are not paid).

Cancellations:  No charge for Venue cancellations at least 4 hours before the event.  $75 plus GST charge for cancellations less than 4 hours before the event and before the host arrives.  After host arrives, Normal charge will occur where cancelation arises from double booking or other voluntary cancellations (such as for a function, or to show a sports event, or for no reason). In the case of catastrophic AV failure, the host will run the “No AV emergency show” which will incur a $200 plus GST chargeCancellations where Funky Bunch and the Venue both agree attendance numbers are too low to proceed (which host cannot agree without approval from Funky Bunch management) will incur a $75 plus GST charge.    

Changes to audio-visual gear: If any audiovisual gear supplied by the Venue is moved, unplugged or altered between events (even if those changes are then reversed) the Venue must inform Funky Bunch at least 72 hours before the next event, so that Funky Bunch can choose to do a line test if it wishes.     

Functions: Funky Bunch organises many functions, including corporate events, fundraisers, sporting club and social events. Venues that run weekly pub trivia/bingo become instantly “preferred venues” – we will always recommend and books these events in preferred as a matter of priority. We ask that when enquiries are made to the venue, that Funky Bunch be suggested as a recommended source for entertainment. Functions operate on a different pay-structure than weekly pub trivia/bingo, and we ask that your weekly rate never be disclosed to the client. Confidentiality: The Venue will not disclose the price of the trivia/bingo to any third parties or clients. This includes enquiries regarding separate functions. In the event the Venue is seeking Funky Bunch for functions outside of the weekly show, the fee will be negotiated on a case by case basis. 

Safe workplace: Funky Bunch takes its legal and moral obligations to provide a safe workplace extremely seriously, and wishes to ensure the host and all guests remain safe.  The Venue must do all things it can to create and maintain a safe work environment, including being responsible in the service of alcohol, monitoring crowd composition and behavior, removing tripping, slipping and other physical hazards, maintaining safe noise levels, maintaining fire exits and removing fire hazards.  

Indemnity: The Venue indemnifies Funky Bunch against all loss and damage that Funky Bunch suffers in connection with a breach of this agreement by the Venue or any negligence by the Venue in connection with the events. 

Liability: To the extent permitted by law, Funky Bunch’s liability for all claims under or in connection with this agreement is limited to the lesser of $1,000, the re-supply of its services under this agreement or the cost of such re-supply.
